    Jury awards $6.1 million in McDonald's strip search case

    SHEPHERDSVILLE, Kentucky (AP) -- A jury awarded $6.1 million Friday to a woman who said she was forced to strip in a McDonald's back office after someone called the restaurant posing as a police officer.
    Plaintiff Louise Ogborn smiles as she testsifies about being strip searched for more than three hours.

    Louise Ogborn, 21, sued McDonald's Corp., claiming the fast-food giant failed to warn her and other employees about the caller who already struck other McDonald's stores and other fast-food restaurants across the country.

    "Louise has stood up for what happened to her and what McDonald's failed to do for three-and-a-half years, and this jury just vindicated her completely," said her attorney, Ann Oldfather.

    McDonald's is evaluating whether to appeal the decision, a spokesman said.
    "While we are disappointed with the verdict, we remain vigilant in our efforts to protect our employees and provide them with a safe and respectful workplace," said William Whitman, a spokesman for McDonald's USA.

    Ogborn had been seeking $200 million. McDonald's Corp. attorneys argued the company was not responsible and contended the company was being sued because of its deep pockets.
    Ogborn accused the company of negligence leading up to the events in April 2004, when she was detained for 3 hours.

    In thelawsuit, she said someone called the restaurant in Mount Washington impersonating a police officer and gave a description of a young, female employee, accusing her of stealing from a customer. The caller demanded the woman be strip searched.

    Ogborn was forced to undress, endure a strip search, and to perform sexual acts, the lawsuit said. The events were captured on surveillance video, which was shown to jurors during the trial.

    A former assistant manager, Donna Summers, was placed on probation for a misdemeanor conviction in relation to the incident. Her former fiance, Walter Nix Jr., is serving five years in prison for sexually abusing Ogborn during the 3-hour search.

    A Florida man, David Stewart, was charged with making the hoax phone call but acquitted last summer. Police have said the calls stopped after Stewart's arrest.

    That's absolutely ridiculous!

    I don't care if I witnessed with my own eyes one of my employees stealing something, I'm smart enough to know that everything from the moment that young girl walked into that office was wrong!

    That interview with the supervisor was disgusting.

    I think it's irrelevant whether she could, or couldn't escape. It's happened now and it wasn't her fault.
    She was violated and sexually abused. I think $6.1 million is excessive, but I don't think you can't put a price on losing your dignity and being sexually abused.
    Who knows what kind of trauma she is suffering from this now.

    I remember watching this story on 20/20, and thinking how the manager could have been so stupid as to believe a stranger on the phone and do every little thing he was instructing her to do.

    This is wrong from the word go. First, the managers are all stupid.

    The girl shoulders some of the blame. She wasn't a 5 year old. She was old enough to understand NO ONE had the right to force her to remove her clothing at work. She has to accept part of the blame.

    Summers should be in jail for sexual assault.

    Yet more evidence of common sense becoming extinct. Yeesh. If I were in the shoes of the victim I would have stood my ground and demanded a cop show up in person and escort me to police headquarters with warrant in hand. Probably would have wet myself several times but there's no way I'd let anyone demand that I strip unless a weapon was being waved in my face.

    I don't blame the victim but I do question WTF were they all thinking? Was anyone thinking? What cop demands private citizens detain, question & search a supposed criminal?

    She's only 18...
    And she comes across as someone who would do as she's told. She probably didn't realise it was happening/going to happen until it was too late. She wouldn't have realised she was going to end up naked when she was told to remove just her work uniform.
    I feel so sorry for her...probably her first job, she wouldn't have wanted to go against her managers demands so she did as she was told.


    At least with that 6.1mil she wont have to work at McDonald's again

    I don't think she shoulders any of the blame.

    I watched some of her interview and put myself in her shoes. Reasonably young girl working her first job who is taken to a room on suspicion of stealing by her manger who is the authority of her. Then she is led to believe a police man is on the phone and she is asked to strip. She would have been extremely scared.

    I know it's easy to say 'Oh, but I would have ran away before any of this happened', but at that point the girl probably had no concept of what lay ahead. She had no clothes on and would have either had to run into the parking lot or into the store with nothing but an apron covering her breasts.

    She obviously didn't enjoy it. You can see her begging her manager to let her out, to let her go. And seriously, her manager is twice her age, what a sadistic bitch.

    I agree that manager is definitely sadistic she cant be that DUMB about being had and bringing her fiance in tow to sexually abuse her makes me think that they somehow was involved. He coerced her to giving him a blow job thats fucking sick and seriously wrong - Both the manager and the fiance need to be prosecuted.

    i dont get it why wasnt these people charged w/confindment and have more serious charges brought againt them their all incredibly stupid even the girl ,were they the only people in the building ? even though shes young she would have to know what was happening was wrong i would of went midevil on them at a certain point ,why didnt she scream or something
