    The U.S. Supreme Court will consider Friday whether to take up a lawsuit challenging President-elect Barack Obama's U.S. citizenship, a continuation of a New Jersey case embraced by some opponents of Obama's election.

    The meeting of justices will coincide with a vigil by the filer's supporters in Washington on the steps of the nation's highest court.

    The suit originally sought to stay the election, and was filed on behalf of Leo Donofrio against New Jersey Secretary of State Nina Mitchell Wells.

    Legal experts say the appeal has little chance of succeeding, despite appearing on the court's schedule. Legal records show it is only the tip of an iceberg of nationwide efforts seeking to derail Obama's election over accusations that he either wasn't born a U.S. citizen or that he later renounced his citizenship in Indonesia.

    Among those filing lawsuits is Alan Keyes, who lost to Obama in the 2004 Illinois Senate race. Keyes' suit seeks to halt certification of votes in California. Another suit by a Kentucky man seeks to have a federal judge review Obama's original birth certificate, which Hawaiian officials say is locked in a state vault.

    Justice Clarence Thomas picked up the petition to hear New Jersey attorney Leo Donofrio's lawsuit after it was denied by Justice David H. Souter. Justice Thomas referred it to the full court, which decided to distribute the case for the judges' conference.
    The decision to put the case on Friday's docket resulted from more than a dozen lawsuits challenging Mr. Obama's right to be president based on his citizenship at birth. The issue preoccupied many conservative bloggers in the weeks before the Nov. 4 election.ASSOCIATED PRESS President-elect Barack Obama was born under the jurisdiction of a foreign power, Britain, and is therefore ineligible to serve as president of the United States, according to a lawsuit that has reached the Supreme Court.
    Some legal analysts say the lawsuits have little chance of success. The Supreme Court rarely grants the kind of court orders - or stays - sought by Mr. Donofrio.
    "Nothing in what we've seen from the court so far suggests any likelihood the court is actually going to take the cases," said Eugene Volokh, constitutional law professor at the University of California at Los Angeles School of Law.
    Nevertheless, for the lawsuit even to make it to the docket raises the possibility of an unprecedented case going before the Supreme Court . At least four of the court's nine judges must approve before the case is heard.
    Mr. Donofrio originally sued New Jersey Secretary of State Nina Mitchell Wells, seeking a court order to stop the Nov. 4 presidential election. When that was denied, he amended his complaint to stop the Electoral College from certifying Mr. Obama as the winning candidate when it meets Dec. 15.
    Unlike many of the lawsuits regarding Mr. Obama's citizenship - which claim he was born on foreign soil - Mr. Donofrio's case concedes that Mr. Obama was born in Hawaii as he claims. Mr. Donofrio contends, however, that Mr. Obama is not a "natural born citizen," as Article II, Section I of the U.S. Constitution requires.
    "Don´t be distracted by the birth certificate and Indonesia issues," Mr. Donofrio said in a statement on the Citizen Wells Web site. "They are irrelevant to Senator Obama´s ineligibility to be president.
    "Since Barack Obama´s father was a citizen of Kenya, and therefore subject to the jurisdiction of the United Kingdom at the time of Senator Obama´s birth, then Senator Obama was a British citizen 'at birth,' just like the framers of the Constitution, and therefore, even if he were to produce an original birth certificate proving he were born on U.S. soil, he still wouldn´t be eligible to be president."

    Am I understanding it: he is saying that since Obama's father was Kenyan, even if Obama was born in Hawaii to an American mother, he still can't be president? If that's not an American, then I don't know what is!

    Let's see, my father was born in Oklahoma, his mother was born in Texas and his father was an immigrant from Ireland. Does that make my father a nonAmerican? I don't think so.

    The fact is, this theory of law has been tested many times. Children of illegal immigrants who are born in the U.S. are American citizens, so even if they deport the parents, they cannot deport the children.

    I don't think the Supreme Court would be stupid enough to try and stop Obama from taking office, after they appointed Dubya's dumb ass in 2000. They're still catching hell for that.

    And why am I not surprised that Alan Keyes and Clarence Thomas are involved?

    So who, in the alternative, would become President? Can't be John McCain. He was born in Panama, while his father was stationed there BEFORE a US Naval base was established there. He was (verifiably and not simply by gossip) wholly unqualified to run for POTUS. He was most certainly not a US Born citizen. He is and was a citizen because he was born of US citizens. But all this hoo haw about Obama's birth is typical of politics recently...scream loudest about that which you are MOST guilty of...politics should be renamed hypocrisy.

    It doesn't matter if his father was a citizen or where either Obama (Jr. or Sr.) was born. As long as Anne Dunham was a citizen, that makes Obama (Jr.) one, too as established by Section 8 Article I of The Constitution. No matter where Obama was born, he is a natural born citizen because his mother is one. Surely, the SC knows this since it's very basic Constitutional Law. Are they just bored and have nothing else to do???

    ETA: Obama having British citizenship doesn't matter since he doesn't claim said citizenship and the U.S. government doesn't recognize it. Good grief.

    And another thing: Are these muthafuckas crazy? Why are they wasting money when they know America is broke. Stop this silly shit!

    Alan Keyes and Clarence Thomas are disgusting. If Ralph Nader had used a certain derogatory slur against them, he would have been correct.

    As long as Obama was born on Hawaiian soil, he is American. That is the same law that allows pregnant illegal immigrants to obtain citizenship status for their offspring.

    The conservatives preach morality, yet have none themselves.

    There's a difference between being a citizen and a natural born one. That's why this case is moving forward, foolish or not.

    Having an American parent makes you a citizen, but not a natural born citizen.

    This 'natural born citizen' is the grey area. The Supreme Court has had a few cases on this. And had handed down the decison before that it does not make you a 'natural born citizen'. See ELG vs. Perkins.
