In my job, I have seen plenty of booking photos, and this just doesn't look like one. I could be wrong, but it isn't just the hair etc., it just doesn't look like a booking photo to me.

Totally agree. Here's a conspiracy theory: this was taken sometime after the incident (careful to use the same shirt he was wearing) and released to the media in lieu of the real mugshot. The Malibu sherriff (didn't he beat up Robert Downey Jr in Kiss Kiss Bang Bang? I know there's a connection there...) is holding the real mugshot for ransom because he knows it's what women want.

On the upside my teenager took one look at it and uttered, 'Wow, what a 'tard!' Anything we can agree on totally has to be a good thing.
