I keep thinking about this and re-reading and figured maybe the judge felt he could rule in the hospital's favor because technically she did see her partner at some point:

It still doesn't explain why the kids weren't allowed to see her (I don't think the "too young" excuse washes with a patient who is brain-dead and obviously on her deathbed). I think it's all excuses and technicalities used to deny someone their rights because they're gay. Especially the social worker showing up to inform her she's in an "anti-gay state" or some such nonsense and that's why she can't see her dying partner. I have no idea how that would get so neatly swept under the rug.
