Man Sentenced To 16 To 40 Years
Former Boy Scout troop leader David Mayberry was sentenced for having unprotected sex with a 14-year-old boy.Mayberry, 52, committed the crime knowing he was HIV-positive.
A teary Mayberry cried in court when he saw the more than a dozen family members and friends there to support him.The Montgomery County man, a former Boy Scout leader, admitted to soliciting a 14-year-old online.
The two met in a parking lot where the boy performed a sex act on Mayberry. Prosecutors said the crime was made more horrific because Mayberry is HIV-positive and he knew his health status when he met his victim."Mr. Mayberry is a classic child predator, plus. He is classic because he wants to have sex with children but he is also HIV-positive. He's given a potential death sentence to the victim here," the prosecutor said.
Mayberry was arrested in November 2005 by state agents who said he met a 12-year-old online and arranged to meet that child for sex. But Mayberry was actually chatting with agents from a state task force, officials said. It was through that investigation that investigators learned of the 14-year-old boy.
Mayberry was sentenced to 16 to 40 years. The judge told Mayberry he was absolutely justified in handing down the sentence and said Mayberry didn't care about the child or his health, just his own needs. Mayberry pointed to the victim as the sexual aggressor but there was no evidence to support that, the prosecutor said. Mayberry's mother, sister and church community members testified to his good character in court. His defense attorneys refused comment, as did his family.The judge told Mayberry he didn't buy his claims of remorse.The victim's mother was also in court Monday. She did not want to comment but called the sentence "wonderful."
