    COLUMBUS, Ohio -- A Franklin County grand jury announced Friday that a sheriff's deputy would not face criminal charges for killing a mentally ill man.

    Nasir Abdi was shot and killed by Deputy Jason Evans in December 2005 at an apartment complex after deputies had a court order to take Abdi to Netcare, NBC 4 reported.


    Law enforcement said Abdi had a knife and attempted to use it.


    "He did not have a knife in his hand," said Abdi family attorney Fred Gittes. "Neither witness saw him make any move in any way to attack an officer."

    Two civilian witnesses told the grand jury that Abdi had no weapon and that Evans shot him after deputies Maced Abdi and Abdi moved to cover his eyes.

    "If you are Deputy Evans and a subject was attempting to stab a fellow officer, what do they expect us to do -- throw jelly beans at the person?" asked Ohio Fraternal of Police vice president Keith Fangman.

    "It is always a tragedy when a life is lost, but this can be no question that Deputy Evans acted in accordance with his training and the law," said Leif Bickel, president of the Fraternal Order of Police Capital City Lodge No. 9.

    Attorneys for Abdi's family said that they would consider filing a federal civil rights case.

    "What can you do? This is the system, and we will work with the system and we feel, ultimately, we will prevail," said Somali community elder Abdi Karim Omar.

    **I call bullshit on this..they already had maced him..and where was the supposed knife???? Somali community up in arms over this, and rightly so IMO**

    ...Also ..on a personal note..when I got in my fight with the police...they also took ME to that netcare place for an evaluation..since I was three sheets to the wind and fighting with them..seeing this story is scary as hell!!!..*shiver*

    Sounds like familiar police bullshit. They never waver from the story that someone was armed, even when it's clear they weren't. Trigger happy, testerone-poisoned numbskulls.
    And it's always open season on the mentally ill, alas.

    Right after this happened(the shooting) there was a big demonstration involving hundreds of Somali's at the city hall. They were afraid of a repeat of that..but so far nothing. It does tie into alot of things..newly arrived immigrants, mental illness, police use of force..etc. What I want to know is if he pulled a knife then where the hell is it? The whole thing is sad. I wish our police had some kind of non-lethal force way to immobilize people.

    Well, there is the Taser, but they don't use it properly and it becomes a lethal weapon.
