Life's more comfortable on Death Row: Murderer Billy Joe Johnson

A murderer has requested the death penalty from a California court because he says the prison facilities are nicer on Death Row.
White supremacist gang member Billy Joe Johnson is already serving a 45-year sentence for a different killing in 2004 and is in lockdown for most of the day.
But he has now been convicted of a second, earlier killing, in 2002, and is waiting for a jury to decide his fate.
Yesterday he made a bizarre bid to convince an Orange County jury that he deserves death by telling them he has killed two other people and never been caught.

He also told the court that he's heard Death Row isn't so bad - especially when compared to his current living conditions.
There he claimed an inmate could 'stretch your bones a little bit' with more recreation time than a maximum-security inmate. 'You get out of your confined cell a little more.'
But the 46-year-old career criminal added, 'I don't want to die. Nobody wants to die.'
His lawyer said the 46-year-old reasoned that by the time his death sentence appeals run out, he'll be 65 or 70 years old and won't want to live longer anyway.
Johnson, who acknowledged that he was testifying against the advice of his lawyer, also testified that he's 'proud to be white,' but doesn't have problems with other races 'as long as they don't come into my territory.'
He said, 'I'm not going to back down from nothing,' and 'I'm not scared of anything.'

What I don't understand is if he confesses, asks to be put on death row etc - why would he be entitled to appeal. Surely he should just be executed at the next available opportunity.

No need for appeals if he has actually requested to be there

I'm ALL about the death penalty but I say keep this one off death row.

He should be suffering a lot more. He killed two people. Put him in a darker, colder, crappier place and throw away the key.

Of course he doesn't want to be in the general population in the prison. He'd be Bubba's bitch in 2 seconds. If he's in death row, it's a nice private cell.
