    The truck driver who maimed Tracy Morgan in that horrible car accident is scoffing at Tracy for claiming financial hardship, saying Morgan was certainly rich enough to afford a limo at the time of the crash.

    It's pretty incredible. Tracy and the other victims are suing Walmart, claiming driver Kevin Roper caused the accident because he was sleep deprived. Roper has filed new legal docs, asking the judge to include him in the case so his rights are not compromised.

    Roper is also asking to put the brakes on the civil case until his criminal case runs its course. Morgan wants to press ahead with the case because he needs the money from a judgment, presumably since he can no longer work.

    Roper seems to say in legal docs ... Morgan's financial woes don't hold a candle to his. And his evidence of that is the fact that Morgan was being driven in a fancy limo, and Roper's just a truck driver.

    One person died in the crash.

    Roper may not have to worry about paying the rent, because if he's convicted of death and assault by auto he could get 30 years in prison.

    What does being in a limo have to do with anything? If Tracy was able to earn $X million a year and now he can't, that's considered hardship. Why should he have to compromise his way of life because some idiot fell asleep at the wheel?

    It was probably a limo supplied by the casino he was appearing at anyway. This guy sounds like a real ahole.

    Is Tracy and the others, even suing this guy? From everything I have read, it sounds like they are suing Wal-Mart, not the driver himself.

    Normally you sue the company and the driver. Also remember that Roper isn;t making these decisions on his own. He is represented by counsel who is calling the shots and making stupid statements. TMZ is also spinning it as they write, Roper seems to say in legal docs There is NO doubt that Tracy was injured but I do doubt the degree that has been implied in statements from his camp. I hate all the legal manuevering in these cases.

    why would anyone sue the driver? he probably isn't worth enough to cover tracy's medical costs.

    You sue everyone involved. It's our rediculous legal system digging into all pockets to score the best payday. The driver caused the accident. He just happened to work for Walmart so they will be sued since it was their truck. Seems the driver broke the rules too. If he can prove he was pressured to drive too many hours, he will then sue Walmart too stating they are the real cause and unsafe labor practices harmed him. A legal circle jerk all the way around. I'm always amazed that you can be found not guilty in crimnal court but then still found guily in civil court for the same thing.

    I was sued years ago for a car accident. I was rear ended, and the force pushed me into the car in front of me at the red light. The insurance of the person who hit me covered my damages. I did not sue. My insurance paid the damages of the person whose car I was pushed into. They then sued ME! I was furious that my insurance company did a few depositions, and then settled giving them 10k.

    ^^^ it's annoying that they paid the drive 10k, but it was probably cheaper for the insurance company in the long run.

    in this case, i didn't realize they were suing the driver. i just thought he was deposed because he works for walmart. and they probably do impose crazy deadlines and the driver wasn't safe. not sure how easy that will be to prove.

    I thought our system was complicated but nobody gets personally sued. It's the insurance companies who take action against each other, and if the driver is uninsured (which is rare but if it's a stolen car or a hit and run, or an idiot driving without a licence) it goes under the Nominal Defendant scheme and the Motor Accidents Authority allocates it to one of the big insurers. That way no victim has to miss out on compensation.

    The children of James McNair -- the comedian who was killed in the crash that severely injured Tracy Morgan -- got a $10,000,000 settlement from Walmart ... according to court docs.
    McNair was killed when a Walmart truck driver plowed into the van carrying him, Morgan and a few others home from a show they'd just performed.
    The driver, Kevin Roper, has pled not guilty to vehicular homicide and is awaiting trial.
    Morgan's lawyer updated the comedian's condition Friday, saying, "Tracy is working very hard to get better, physically, emotionally and mentally ... because in all three areas, he still has a struggle on his hands."

    I wonder if the family will actually receive the settlement or it will be repealed. It was awarded pretty quickly compared to so many other cases. Still not nearly enough money, Walmart is such disgrace.

    Poor guy feel badly for Tracy.

    This whole story is so sad. I really really hope Tracy and the others are able to make a full recovery sooner than later.
