    What I don't understand is given the Judge's harsh words (see below), why was she allowed to post bail for a probation violation - Paris Hilton actually did her time. She's starting to look MUCH more responsible than this idiot, and it pains me to say that, it really does!

    After a topsy-turvy day in court, Lindsay Lohan was found in violation of probation – and sentenced to four months in jail – on Friday, for allegedly stealing a $2,500 necklace.

    The actress, who was allowed to post bail, was also sentenced to 480 hours of community service by a Los Angeles judge.

    Lohan, 24, arrived at Lynwood Jail at approximately 5:30 p.m. PT in a sheriff's vehicle – her fourth trip to the facility – where she was given an orange jumpsuit and, according to a sheriff rep, will be released "in the very near future," most likely Friday night.

    Earlier in the day, Lohan, 24, scored a legal victory when Judge Stephanie Sautner reduced her felony grand theft charge to a misdemeanor, explaining she was "giving [Lohan] an opportunity," because reducing charges for nonviolent defendants is common in more serious cases than Lohan's.

    Because of the reduction, Lohan was granted $75,000 bail for the probation violation while pending appeal. Judge Scolds Lindsay But the judge's goodwill didn't come without harsh criticism from the bench.

    "Would a person with any brains walk out with a necklace with [security] cameras on?" Judge Sautner asked. "Maybe it's brazenness, stupidity – I don't know what. Perhaps it was a desire to hide in plain sight."

    Lohan's attorney argued the actress walked off with the necklace because of simple absentmindedness, which the judge rejected.

    "I see her intent [to steal] and I see a level of brazenness," Sautner said, adding that a reasonable person would've returned the necklace immediately. Lohan waited 10 days before returning it, and only after she learned of an imminent search warrant to be executed on her home, Deputy District Attorney Danette Meyers alleged. "It was like, 'Let me see what I can get away with,' " Sautner said.

    "She thumbs her nose at the court," the judge continued, as Lohan dabbed tears from her eyes. "She walks into court with FU on her fingernails. I don't know what that's all about." Community Service at the MorgueOf the 480 community service hours, Lohan was ordered to perform 360 of them at the Downtown Women's Center. "Then she will see how truly needy women have to live and that might change her," the judge said.

    As for the remaining 120 hours, those would be performed at the L.A. County morgue "to see what happens when people drink and drive," Sautner said. Lohan must enroll in those programs within a week after her release on bail and must complete them all within one year.

    Lohan's attempt to overturn the four-month sentence is expected to be heard in an appeals court in coming days. Meanwhile, her trial for the misdemeanor theft case is set for June 3.

    Okay, so her appeal will be held in the coming days. If her appeal is denied does that mean she will be taken into custody right away for the 120 days?

    Really!! As a person that pays taxes in this shitty state, I really wish they would just close the book on this dumb ass. Every time, the same thing happens. It's a whole big production, the prosecutor, the judge, the clerks, the court employees, the extra police, the escorts to Lynwood, the booking, the jumpsuit, the mugshot, the extra police and escort on the way out, etc, etc, etc....It's a waste of taxpayers money. Nothing is ever going to happen and honestly, this is the most attention this dried up has-been gets every year. It's like her version of a red carpet event. So, California and LA County, quit with the production and let her go. At this point, it doesn't matter. No amount of jail time or probation will change this self entitled snot.

    But for clarification, here's what I posted:



    If her probation is being revoked, which is what it sounds like, then it's a separate hearing and the burden of proof is lower (preponderance of the evidence as opposed to beyond a reasonable doubt). She doesn't have to have been convicted of another crime before a probation revocation hearing, she just has to be shown to have violated her probation. If her probation is revoked, she may go to jail or prison based on whatever plea or sentence she had on the prior charge, but she will still be entitled to a trial on the new charge. If she pleads guilty or incriminates herself in some way concerning the new charge in her probation revocation hearing, that might be used against her in a subsequent criminal trial, though.

    A parole hearing is another ball of wax and that's done before a board of pardons and paroles. They have a lot of power to put someone's ass back in prison and I'm guessing their burden of proof is at least equally as low.

    Does that make sense?

    But if Kihan is allowed to appeal, why wasn't Hilton?

    Also, despite the great explanations by Nicki & Laurent, I'm still confused why she is able to appeal her probation being revoked and also why she's able to post bail again - surely the whole point of her probation being revoked is that she shouldn't be able to just post bail & walk free?
    OR... Is all this to be decided at a later date, at a different hearing?

    My understanding is that there is generally a hearing on whether or not someone has violated probation. In this case, the hearing was on the necklace theft, so when the judge violated the probation, Lindsay should have been able to put on evidence that she didn't violate - at least that's what the appeal argument might be. In Hilton's case, I think she did have the hearing on her probation violation and has found to be the crappy person she is - hence to the pokey.

    I don't think Paris appealed her ruling, since at that time she only expected to do a day or two because of overcrowding, and I suspect her parents had a deal with the warden.

    It was a shock when the judge demanded she do more of her time. I think Lynwood has a different sheriff/warden since then.
