Lindsay's Criminal Battery Case -- Full Steam Ahead

Just when Lindsay Lohan thought her legal problems couldn't get any worse ... TMZ has learned cops are reigniting their investigation into allegations she attacked a Betty Ford staffer.
Sources connected to the investigation tell us ... in the last two days, the Riverside County District Attorney's Office sent investigators to meet with key witnesses who were with Lindsay on December 12, 2010 -- the night she allegedly got into a tussle with Dawn Holland.
We're told cops told the witnesses they were conducting the investigation because the D.A. is still determining whether to pursue criminal assault charges against Lohan.
Sources tell us ... investigators wanted to know if the witness could testify if it was Lindsay or Dawn who was the "aggressor" during that fateful night. They also wanted to know if the witness could describe any sort of injury Dawn may have suffered during the incident.
We're told investigators also wanted to know if the witnesses would cooperate with authorities if the case went to trial ... but sources say the witnesses wouldn't give a definitive answer.

Lindsay Lohan Could Dodge Probation Bullet

A legal technicality could save Lindsay Lohan from going to jail for her alleged probation violation -- or at least delay it.
Judge Stephanie Sautner -- who will preside over Lindsay's felony grand theft case -- will hold a preliminary hearing next month, in which prosecutors will present evidence she allegedly stole a necklace from a Venice jewelry store.
In California, prosecutors often don't present witnesses in preliminary hearings -- rather, police officers testify about what the witnesses told them.
If prosecutor Danette Meyers uses police officer testimony to make her case, that cannot be used to determine if Lindsay violated her probation, because it's hearsay. Under California law, judge's are not permitted to use hearsay involving key witnesses to violate a person's probation.
Short story -- it's likely Judge Sautner will not make a decision on whether Lindsay goes to jail for her probation violation until after the trial.
Here's the bad news. Even if Lindsay is found not guilty at trial, Judge Sautner could still violate her probation and throw her in jail. The standard for determining a probation violation -- probable cause -- is much lower than the standard to convict someone of a crime -- beyond a reasonable doubt.
Just ugh.....

Lindsay Lohan may use Good Friday to her advantage

HollywoodNews.com: Lindsay Lohan may be avoiding her theft case for a little bit longer as she reportedly simply can’t deal with the court matter on Good Friday.
Lindsay’s attorney, Shawn Holley, will reportedly be asking the judge on the case to postpone her hearing so she can observe the Christian holiday, states RadarOnline.com. Lindsay’s attorney reportedly discussed the matter with the judge in a meeting last week.
Now, Lindsay would reportedly still appear in court on Friday, but only to hear the ruling on the motion to postpone the case.
If the case is postponed, Lindsay’s matter will likely be dealt with next month.
Why do you think Lindsay Lohan is postponing her case? Just for Good Friday?
