But the probation report is supposed to include everything. I doubt this is the only entry that is cause for concern. It is then up to the judge to review the report and see any action should be taken.

Lindsay fessed up to her probation officer ... she was drinking Kombucha tea, which has an alcohol content of 0.5% or less ...

Translation - Lindsay came up with the kombucha tea excuse to give her probation officer before her next test comes back positive to alcohol. Hence:

Lindsay was so bold ... she actually left one of her alcohol ed classes clutching a bottle of Kombucha.

Just to have an alibi. This way she can drink as much vodka as she wants and when she fails her tests it'll always be the kombucha!

Lindsay Lohan -- Warming Up to Jail

Lindsay Lohan's confidence is starting to wane -- sources close to LiLo tell us she is finally getting it through her head she can't avoid jail and is now "seriously considering" taking a plea deal.

As TMZ first reported, Judge Keith Schwartz offered LiLo and her attorney Shawn Holley a deal that includes three months in jail ... which get whittled down to 19 days because of jail overcrowding.

Lindsay has been adamant for weeks ... she would never take a plea deal because she feels she did nothing wrong. Sources close to Lindsay tell us she still maintains her innocence ... but reality is starting to sink in and Lindsay is beginning to understand the risks of going forward with a trial.

If she loses at trial, she could get more than a year in jail for the probation violation ... plus prison time for the felony grand theft.

If Lindsay accepts the deal, Holley must tell the judge on Wednesday. Lindsay will be back in court Friday to either take a plea or declare war.

As soon as she pleads guilty, she will admit violating her probation for the DUI, I think she has a year to serve on that. The 3 month plea will only be for the felony necklace theft, she will serve some additional time on the DUIs, I would presume.
