    Lindsay's mess is Lindsay's fault. She's an adult and she's responsible for her own actions. Her parents no doubt contributed to her problems and sat by watching their little moneymaker fuck herself up while earning them some nice cheques, but at the end of the day her actions are still her responsibility. God I hate that whole family.

    Lindsay Lohan's lawyer says her client is innocent -- but that aside, the necklace in question isn't valuable enough to trigger a felony grand theft charge.


    Shawn Holley (no longer Shawn Chapman Holley) tells TMZ, "We intend to challenge the prosecution's case because the truth is, Ms. Lohan didn't steal anything. But even if she had, it seems to me that the appropriate charge, based on the fair market value of the goods, should have been petty theft and not grand theft."

    TMZ broke the story ... various Los Angeles jewelers believe the necklace LIndsay allegedly stole isn't worth nearly the $2,500 Komofie & Co. was asking. Under California law, the item in question must have a "fair market value" of more than $950 to constitute grand theft. The jewelers we spoke with said the fair market value ranged between $800 and $1,000. If the value is $950 or less, it would be petty theft, a misdemeanor punishable by six months in jail, rather than one year in prison.

    There have been countless cases in which people charged with grand theft successfully defended themselves by asserting that prosecutors overinflated the fair market value of the item that was allegedly stolen.



    As Holley put it, "A $5 lump of coal with a $2,500 price tag is still a $5 lump of coal."

    What bs. When LL walked out the door of that store she knew the cost of the necklace she was stealing. She also knew, from trying to talk down the price of a ring, the store expected to be paid what they determined their product was worth. Idiot should have "borrowed" from a cheaper store then.

    Lindsay Lohan just can't wrap her head around her latest legal charges, according to a source close the actress.

    "She had a lot of uncertainty [before the hearing] even though she really, truly believes she didn't do anything wrong and the whole thing was a misunderstanding," says the source. "But she really does think it's so ridiculous and people are just out to get her."

    Lohan, 24, pleaded not guilty to a felony charge of stealing a $2,500 necklace. After a stern warning from the judge, the troubled star was released on $40,000 bail Wednesday.

    On Thursday the actress Tweeted, "i would never steal, in case people are wondering. I was not raised to lie, cheat, or steal."

    While Lohan awaits her next hearing, set for Feb. 23, she is still baffled by the latest turn of events, claiming she thought she was allowed to borrow the necklace from a Venice, Calif., jewelry store.

    If convicted, the actress could face up to three years in prison, but her attorney Shawn Chapman Holley told CNN that the grand theft charge is "entirely defensible."

    While Lohan has had her fair share of troubles – with at least five rounds of rehab, three trips to county jail and multiple court appearances – friends insist that since leaving rehab at the beginning of the year she has been trying to turn her life around.

    "She's finally got things on track, she's trying to do the right thing, and people are constantly trying to bring her down," the source added.

    And Britney worked her ass off touring for years. If Larry Rudolph could manage to corral all the crazy in Brit, Linds should have been a breeze.

    Linds doesn't want to work. She wants to steal and walk around in designer dresses, waving her designer water, for a fee.
