I'm not sure either. When I've had legal representation, it was the lawyer's job to advocate my position on my behalf.
Maybe one of our legal minds can say something about this. Cosby's a public figure, and she isn't. It's easier to comment on a public figure without it being seen as defamation. She's a private citizen and would have more protection, but she went public willingly, I think?
A defense to defamation is whether the allegation is or isn't true. Provably true. Can she find a way to more or less prove he drugged and groped her? Can he find a way to prove he didn't? Were his lawyer's denials malicious toward her? Etc. I'd love to see this scenario analyzed.
