There is no evidence that she touched him to begin with. Or slapped him to begin with. Has he claimed that that was the case?

If she had hit him first, he could have lodged the claim against her, and had her charged with assault. Tawny Kitaen, the actress, was charged with spousal battery, by her pro baseball player husband and got in a lot of trouble for it. Brown could have done the same, but didn't.

This leaves aside the fact that just because someone takes a swing at you, you are not legally entitled to beat them up like that.

Thought I read on here that they were documented to have had a violent relationship and even Rihanna admitted that she had hit him. Now all of a sudden he goes to court and she 'conveniently' swept that fact under the rug.

You do raise a good point, I dont know why he didnt bring that up as well. Maybe he doesnt really care that she hit him and realizes that he was wrong to bust her up like that. Maybe he figures itd sound like a cop out and no one would believe him or care if he said 'But she hit me first'. Most places Ive seen originally painted the picture that she flipped out on him to begin with and he hit her back. Most people also seemingly never took that into consideration and immediately threw him under the bus. I mean, cmon, seriously. I look at this situation and I dont think for a minute that she didnt do a thing to him. She did something and I doubt it was just arguing, Im pretty sure she hit him in some way a few times. But then again, I cant say what hes thinking.

He may not have mentioned it if she ever went after him because his actions took it far over self-defense. Chris Brown has MMA training. He could easily restrain a small woman who went after him without beating her so badly.
