I have always wondered, though, how having alcohol residue in your mouth from taking a drink like 5 minutes before would affect your blood alcohol level. It seems to me like it would distort your readings.
Well at least down here, they don't do the breathalyzer right away. The officers sit with the defendant in the same room and it's called an observation period to make sure they don't regurgitate or add anything to their mouth. I'm not sure how long it is but it's certainly at least an hour or more before they issue the breathalyzer.

What is "consuming alcohol in a closed area"? Is it like an open container thing? That he drank the shot while sitting on his motorcycle?
Apparently this was in a national park, which probably has rules about alcohol on their premises. And he was arrested by park police.

From my experience, you used to be able to drink just about any alcohol on the beach area. Then, around two years ago, the park service banned it. I seriously doubt that Bruce was in that part of the park. Sandy Hook/Gateway, has a big restaurant and bar looking place just past the toll booths going into the park. If Bruce was running into partygoers, that has to be where it was. I think it's like a large two-story building, with a giant parking lot, and literally on the Jersey shore.

afaik, there has always been an open bottle law on the beaches. that might have changed recently in some areas, though.
They banned alcohol of any kind on Gunnison Beach. I'm not sure if it applies to other places. They had a very intrusive approach to enforcing it. In one case, literally going from one beachgoer to the next, asking if they had alcohol in their coolers.
