    I hate this asshole with a capitol HATE!!! Smug fucker was making some sort of Cuban shit. Mr. Honeythorn's parents are both from Cuba and the shit this tool was making made the hubs go WTF?? We don't eat that shit! It was like Me, a Mexican going to Taco bell and giving it to you and saying it was authentic Mexican grub. It was that kind of fuckery.

    Our sources say Stephanie's lawyers are challenging the prenup, and they're negotiating with Bobby's legal team. The likely outcome is a settlement where she'll get something more than what the prenup provides.

    She might be able to get something. Forbes wrote this about NY prenups after one was over turned in 2013. Maybe she will protest based on the "conscionable" clause:

    In summary, in order for a prenup to be effective, both parties must have their own separate attorney. Plus, the prenup must be:

    • Written. Oral prenups are not valid.
    • Executed voluntarily and without coercion. A prenup that’s signed the day before the wedding can be invalidated.
    • Executed only after full disclosure. If you hide assets and/or liabilities, you run the risk of invalidating the prenup.
    • Conscionable. A prenup cannot be unconscionable. In other words, the prenup could be invalidated if the agreement is too lopsided, with one party awarded almost everything and the other receiving only a pittance.
    • Executed by both parties, preferably in front of witnesses (or a notary). Some attorneys even recommend having a judge witness the signing to make sure that neither party was coerced into signing.
    • Written in a recordable format, such as a real estate deed

    ETA: I just remembered the Seinfeld when George asked his fiance Susan to sign a prenup because he thought she would break up with him if he asked. Instead she laughed and said something like, "I make more than you, go ahead, give it to me, I'll sign it." She was really, really funny in that scene.

    It seems eerily similar to the Cruise-Kidman breakup. Married for about 10 years, Husband with a prenup and way more assets files for divorce. I think that March deserved some kind of bonus parting gift for putting up with his ginger-encrusted chorizo.

    The 10 year limit is a myth. A pre-nup doesn't expire unless there is a sunset clause written into the agreement.

    um, it's not a myth. i'm not talking about prenups, i'm talking about the equation that is used in CA for spousal support.

    Either way, sunset clauses are sometimes written into prenups. I just read a comment from an attorney saying that they can be counter productive because the spouse with the most assets will pull the plug on the marriage just before the clause comes into effect. That's why I was wondering about the 10 years.

    In ny 10 years is still considered a short term marriage.


    And here it's generally about the one that earned more getting more. If you're married more than 20 they try to balance it out a little better, but otherwise no. NY is an 'equitable distribution' state, so there aren't really clear cut laws on asset and property divsion like community property states. A lot is up to the judges discretion.
