Halle Berry says a paparazzi photographer went too far to get a shot of the actress holding her infant daughter, trespassing onto her private property and snapping them hanging out in the backyard.
The Oscar-winning actress was upset when pictures of her holding four-month-old Nahla Ariela Aubry showed up on the Internet and in two celebrity magazines. In a statement, Berry disputes the notion that the photos were taken when she was "out and about in Los Angeles."
Evan Spiegel, an attorney representing Berry, said a criminal complaint has been filed and an investigation is under way. He said there are witnesses who saw the photographers in the middle of a "very blatant and invasive trespass."
A person who answered the phone Friday at Fame Pictures, the agency that distributed the photos, said he had no immediate comment.
Besides pursuing criminal charges against the photographer, Berry is seeking to get the photos removed from the Web. In her statement to The Associated Press, Berry said she will never sell pictures of her children.
"I have long since come to terms with the fact that choosing a career as an actress has made me a public figure, but my baby has made no such choice, and unless and until she does, I will do everything I can ... to keep her out of the public eye," the statement read.
The photos, some of which have blurred leaves in the foreground, show Berry holding her daughter, standing near a table in what appears to be a private backyard. Berry's mother is also in some of the pictures.
Berry said she wants anyone who used the photos to know they were illegally obtained. Representatives for In Touch and Life & Style magazines, which ran the photos, had no immediate comment Friday.
Berry gave birth to Nahla, her first child, in March. Nahla's father, model Gabriel Aubry, was not seen in the photos.

Stay off their damn property, paps.  If they are out and about in public then they are fair game, but not in their own backyard. What's next? Breaking and Entering?

^ I agree. Something must be done to the paps/vultures. I hope she wins the lawsuit. Hopefully it will discourage some of the craziness. The celebrity baby hysteria really needs to cool off.

No shit it's a "blatant and invasive trespass." I love paps' pics of celebs, but when they're in their own back yard it's just wrong. It's their private property, so they do have a legitimate expectation of privacy.
There's laws against peeping toms, so it's about time they set a precedent for this.

When it happens to Britney it seems funny, wheras it seems completely wrong to do this to Halle. strange.
Overall, spying in someone's backyard is sleazy and wrong, wheras skanks know what they're getting into exiting cars with no panties!

Well who is worse, them for taking the photo or us for looking at them? I mean we could tell they were taking without her knowledge when she thought she was safe. So all of us are just as guilty.

None of us were sneaking around Halle's backyard, so I think the paps were moreso in the wrong.

No, it's not funny or ok even when it happens to Britney. No matter who you are or how stupid, you should have a reasonable expectation to privacy in your own back yard.

I totally agree with Halle. It's her personal space and while she is at home people should respect that space. Any time I see a pic. of a celeb in their backyard or in a hotel room I am sickened by the lengths that the paps go to in order to get those photos. I also like that she's not planning to over-expose her child.

I think it's bad when it happens to anyone. I even thought the pictures of Tiny Tom and Suri through the window in their hotel was super creepy.

Celebrities' kids should be off-limits even if their parents don't have the good sense to protect their privacy.
Someone needs to explain to me what the appeal is for these types of photos.
This case is an invasion of privacy and she will no doubt sue.

Yes but without people like us, there would be no paps. They do it because they get paid very well because the public likes to look at the pictures. If people would just stop buying the mags, etc., there would be no need for them.
Did you look at them? Of course ya did! We all did. That was the driving force. The paps knew we would.
