Default Doctors cleared in John Ritter wrongful death lawsuit

The family of John Ritter has lost its $67-million wrongful death lawsuit against a cardiologist and a radiologist, after a California jury on Friday cleared the doctors of negligence in the diagnosis and treatment of the late actor.

The jurors found that Ritter failed to follow radiologist Dr. Matthew Lotysch's advice to see a physician once Lotysch had done a body scan on him in 2001, the Associated Press and L.A. City News Service report.

Ritter died of a torn aorta in 2003.

The other defendant in the case was Dr. Joseph Lee, who treated Ritter the night he died.

Ritter's widow, actress Amy Yasbeck, who testified at trial, and his four children brought the lawsuit. The $67 million they sought was their estimate of the sitcom star's potential earning power.

Previously, the family members received more than $14 million in settlements, according to court records.

In the wrongful-death trial, the jury's verdict was 9-3. In civil cases such as this, verdicts need not be unanimous.

Good! Not that I didn't like John Ritter, but these malpractice suits are ridiculous sometimes. And especially the amount of money they were asking for.

People die, and it's not always somebody else's fault.

Good. People who make up stories to squeeze money out of a practice based on helping people ought to be publically flogged.

It would be like suing a fireman for brusing your ribs while carrying you out of a burning building.

I feel terribly sorry for him and his family, but 14 million is a lot of money, and they probably only got that much in the first place because he was a celebrity. When stuff like this happens to "normal" people, I bet they'd be lucky to even get a few million.

Agreed! We pay way too much for doctor visits and health insurance because of the cost of malpractice insurance.

People die everyday, but that doesn't mean it was someone else's fault. Dr.s do what they can, but not everyone can be saved. Too many people think medicine is an exact science, and if something goes wrong it must be the doctor's fault. I liked John Ritter, but this lawsuit was ridiculous. Even more so that we find out he did not follow the Dr's advice. Did she expect the radiologist to take John to the cardiologist, and make sure he did what he should have? It's the patient's responsibility to do what the Dr.s tell them.

I'm sure she knew--the radiologist's records would have been part of the discovery and trial. I think she and her lawyer were counting on a sympathetic star-struck jury instead of one that actually looked at the facts. And since they'd already managed to get a settlement from the hospital, they probably figured they had a chance to get more.

Well, I really don't consider Ritter's death to be a "medical mistake." He entered the hospital dying and the doctors did the best they could based on their expertise and the information they had in front of them. They shouldn't be punished for that.

According to the radiologist's lawyer (on Nancy Grace ) no abnormalities were visible on the scan. The Ritter family lawyer was insisting that it would have been visible back in 2001. However, there was no evidence.
