    Dennis Quaid Sues Drug Company

Posted Dec 4th 2007 3:19PM by TMZ Staff
Filed under: Celebrity Justice, Sound Bytes, Nurse!
Actor Dennis Quaid and wife Kimberly Buffington have filed suit against Baxter Healthcare Corp., the makers of the drug Heparin.

The couple's newborn twins Zoe Grace and Thomas Boone were mistakenly given a massive overdose of the anti-coagulant drug last month. The Quaid's attorney says the twins "were very critical for a while," but appear to have recovered and "everything looks good." They filed suit because they want to prevent this from happening to any other children, Loggans said.

The 10 unit vial Heparin looks almost exactly as the 10,000-units-per-milliliter vial of the drug.

Three children died in Indiana from a similar mix-up with the drug.

He should sue them aswell as the hospital and the nurses that give the wrong dosage in the first place ......those poor babies But no amount of money will ever erase the trauma that he and his family have gone through.

i don't think the vials look alike at all.

the blame lies with the hospital, he should sue them.

there is a number on each bottle that tells you what the drug is...when i worked in a pharmacy we had to check this number every time we filled an Rx. There are a ton of medications that come in similar looking bottles...those two aren't that bad actually

i think he will sue the hospital, but not while the kids are there. its almost like (i said 'almost) complaining about your food while you are in the restaurant.

They might look alike if it were a different setting and not illuminated with light. They should at least make it two very different colors, not a different shade of blue.

ITA! The blame lies with the hospital and the person administering the medication. The vials clearly state the dosage. It was a terrible mistake but the drug company has nothing to do with it, they just have bigger pockets.

the caps are two different colors. you have to remove the cap in order to stick in the syringe. so the tech/nurse/whatever should've noticed that in addition to the dosage which is clearly marked. i'm colorblind and even *i* can see the difference. baxter is gonna mop the floor with this.

ITA. The difference seems pretty obvious to me, plus you'd hope medical personnel would at least make a quick inspection of the drugs they're injecting patients with.

I commend the Quaids for being proactive about this. Wrongdoing doesn't have to be mutually exclusive here. Until we develop robots to deliver medical care, we are going to find ways to deal with human error. So why not eliminate factors that may contribute to human error, such as more precise drug labeling and packaging?

Medical errors happen everyday across the country. This incident wasn't the most egregious example this year, it just got more publicity due to the celebrity element. The scariest and most unforgivable example that comes to mind is what happened at Rhode Island Hospital this year. Three different surgeons performed brain surgery on the wrong sides of the brains of three differnt patients. Now that is effing up on a grand level.

So are you saying they should sue everyone who is remotely involved in the situation? I go out and shoot someone with a gun, should the person I shot be able to sue the gun manufacturer? I think when too many people are listed in a lawsuit it takes away from the party who is really responsible.
