Brit Back in Court Over Drug Testing

We've learned that K-Fed is going back to court tomorrow, arguing that Brit is violating the Commissioner's drug testing order.

Sources say K-Fed's lawyer, Mark Vincent Kaplan, will go before L.A. County Commissioner Scott Gordon tomorrow morning, arguing that Britney has failed to respond in a timely manner when she is called for random drug testing. We're told Kaplan will ask to modify the existing custody order, giving Britney limited visitation rights.

We're told neither Britney nor K-Fed will be present. And, we're told, this could be a real dogfight.

I was wondering how she was passing the first ones to begin with.

She's really intent on giving K-Fed as much ammunition against her as possible, isn't she?

I think we have our answer as to how Shitney is supposedly passing her drug tests. Her "not responding in a timely manner" to her drug tests, as the article says, could mean she is taking God-only-knows-how-long to show up for the tests.--giving her ample time to wait till the drugs are out of her system (like you said Venus), probably using one of those "Flush Out Your System Quickly" kits that you can buy that quickly detoxes your body of drugs.--or, carrying out some other plan, like obtaining & using someone else's (clean) urine for the tests. I agree with K-Fed's attorney--The Judge ordered random drug tests, so when Shitney is called with no advance warning to give a urine or blood specimen, she should be required to IMMEDIATELY do so, with no time in between during which she could concoct & carry out whatever plan it is that she's been doing to pass these tests so far. (cuz i don't believe for a minute that she has actually been really staying off drugs!)

I'm with you GoldDust - I don't think that she's staying off them, but cheating them in some way.
I also can't believe that the time-line isn't written into the court order.... it doesn't seem to be very forward thinking if its not!

I think it said in one of the recent court order papers that she had 4 hours to show up at the drug testing facility and do her test.

They're in court now, and TMZ reported that her lawyer just told the judge that he just doesn't understand poor wittle Britney's troubles because the judge isn't a pop star. Unbelievable.

Brit's Lawyer to Judge -- You're Not a Pop Star

Britney Spears' lawyer has just told the Commissioner in the custody case that he just don't understand what it takes to be a pop star.

As TMZ first reported, K-Fed's lawyer, Mark Vincent Kaplan, went to court this morning, arguing that Brit's visitation should be modified because she's violating the order requiring her to respond to the drug-testing people within an hour of the time they call.

High-powered lawyer Anne Kiley, who reps Brit, told the judge her client has received calls as early as 8:00 AM. Kiley said pop stars don't get up that early, adding, "You are not a pop star with a number one album, so you don't know." The courtroom erupted in laughter.

Apparently, Kiley got her message across, because the Commish is open to a more flexible timetable that works for Brit.

They're back in court at 10:30 AM PST. Stay tuned.

Britney Spears did not respond to eight of 14 random drug test requests, Kevin Federline's attorney said in court Thursday.

Alleging the singer lives in a "parallel universe," lawyer Mark Vincent Kaplan reminded the court that the singer had been reprimanded three times by Commissioner Scott Gordon for failing to be reachable by phone.

"Mr. Federline doesn't want to take these children out of their mother's life, but what are we to do?" Kaplan said.

Spears's lawyer, Anne Kiley, called the current drug testing procedure "unconstitutional," adding that just because the singer may fail to respond to testing calls doesn't mean she's using drugs. Kiley also pointed out that Spears has passed multiple tests successfully.

Explaining why Spears frequently changes her phone number, Kiley said the singer's number often falls into the wrong hands. When Commissioner Gordon stated that responding to a morning call wasn't an extreme request, Kiley shot back: "But you're not a pop star with a No. 1 album to promote." (Spears's new album Blackout is No. 2 on Billboard.)

Commissioner Gordon ordered both attorneys to reconvene at 10:30 a.m. to hammer out a new plan for testing.

Currently, Spears must submit to twice-weekly random drug and alcohol tests, and is required to give a urine sample within six hours of being called. The drug testing facility is under court order to attempt to reach the singer three times within one hour. A missed test is considered a failed test.

On Oct. 30, Spears's visitation rights with her sons Preston, 2, and Jayden James, 1, were scaled back after her parenting coach was critical of the pop star.

Spears "rarely engaged with [her] children in either conversation or play" during their monitored time together, the coach testified last month.

I wonder if anybody else could use that defense? Why the fuck would it even matter? You do what the court tells you, period. Her lawyer lives in a parallel universe too.

Why are they even having her do random piss tests? Why not just take a hair folicle test once a month?? That shows more than any piss test and tells you how far back the drugs were taken.
