Lindsay Lohan has another run-in with the law on her hands -- this time, possibly, quite literally.

The recently struggling "Mean Girls" actress, who lately has been working to fulfill the community-service and therapy obligations stemming from her probation-violation case, is being sued by a woman who claimed Lohan ran her down in the street.

Nubia Del Carmen Preza claims that, on September 1, 2010, at approximately 4 p.m., Lohan came bearing down on Preza on Alta Loma Road in West Hollywood, striking her with her Maserati.

In the suit -- filed in Los Angeles Superior Court on Wednesday -- Preza claims to have suffered "[d]isabling and serious personal injuries, pain, suffering and anguish" as a result of the alleged accident, and she wants Lohan to pay.
Preza is seeking general damages, medical and incidental expenses, compensation for loss and impairment of earnings, court costs and interest.
Preza's claim is dramatic -- perhaps a little too dramatic, according to TMZ. Back when the incident allegedly occurred, the web site called an account of the run-in into question, noting that no police report had been filed, and that the witnesses to the accident -- a pair of paparazzi, one of whom was on his first day on the job -- chose to sell their video of the supposed incident rather than inform the police.
Black & White Car Rental and 10 other anonymous defendants are named in the suit.
Lohan's spokesperson had no comment for TheWrap.

If her injuries were so disruptive to her life, why would she wait almost 2 and a half years to file suit?
I had someone literally throw himself in front of my car. (I'm not saying this person did this to Lohan, this is just my personal experience):
My car never touched the person, and I was at a dead stop. But, since I was in a vehicle and it was "on" - I was "found" 100% at fault. No witnesses, just my word against his - and the police report (which showed that I didn't touch him)
I exchanged my insurance info with this person (who had a small scratch on his forearm from rolling on the ground), police were there to document it blah, blah, blah.... My insurance premium stayed the same and I forgot about it - heard nothing from them.
2 years later, literally a day before the statue of limitations expired, my ins. called and told me that this person filed a claim for the maximum amount I was insured at the time (around $40,000). And they settled it. (If he wanted more, he would of had to sue me).
Of course my premium went up, and this person walks with $40,000, without me/my car touching him - or moving for that matter.
Mind you, I've never even had a speeding ticket - I'm a careful driver. And had/still have a squeaky clean driving record. It's been years and that incident is off my record now, but it just leaves a bad taste in my mouth with insurance co.'s and how stupid people can be.
Anyway.... if this woman suffered, then she has a right to get properly compensated. If not, what she is doing is a huge waste of everyone's time....
^^ that is pretty fucked up. so he just called your insurance company and said "i want 40.000 dollars", 2 years after it happened, and they just gave it to him? without any proof or any officials being involved?

^^ No, in America, insurance companies don't pay. Or so the story goes.
I don't know who the insurer is but that is one damn odd story. What damages did this person claim to have to be awarded 40K? For sure the insurance company would want proof of injury. They do like quick settlements, meaning they'll settle minor injury claims with weak stories, but not to the tune of 40K. Very fucked up situation.

He took the settlement. I was in my early twenties at the time - a full time student, worked full time, and living on my own. This guy knew I didn't have much. Unless he wanted a 32 pack of Chicken-Flavored Ramen Noodles.
I don't know the "checks and balances" with verifying the authenticity of "bills" stemming from accidents. But, I don't believe they doing a good job at it.
I wish I could say I'm under-exaggerating my part, but I'm not. I was literally at a dead stop (waiting for people to pass) and this guy dropped and rolled, and had a scratch on his arm - similar to a cat scratch.
I wanted to fight it. It was super-fraudulent. What went down, and that he submitted all this paper work hours before the time expired (as opposed to as things happened so there was some kind of a timeline, notice of intent of a claim- something).
What I think really happened - is that he had this problem (if there was one to begin with) before that day, or something happened after-having nothing to do with me. Saw that he could get his problems fixed by using this incident so it wouldn't effect his medical coverage or lack their of, and sent me the bill.
Or just took the money and pretended to be injured all along by submitting false documents.
But, if I wanted to fight, I would have had to hire a lawyer, file suit, get proof (it was my word against his, the police report which had no real determining details - basically the call # they were sent on and the address, that he denied medical treatment, and I was sober and normal. Oh! And the kicker: That he "thought" I was excelling/moving, so he had to drop and roll out of the way. So, because I "made" him think I was moving (yeah, I know) and I was the one in a vehicle and he wasn't, so it was my fault.
Insurance co's, after so long,probably just open the file, read that I was "100% at fault on the paper and just decided settle, its seems like they don't want to spend the time, re-opening an investigation and all that good stuff.
What I really wanted to do (if I had the time/money) was hire an insurance fraud-private investigator. (Like those videos on tv that show people "hurt" on the job but then are seen out at Six Flags with their family?) *sigh*... life's a bitch.
Anyway, sorry for the long response. It still hits a nerve. Can you tell?Not really the money part, (b/c my record was clean, my premium went up, but I made ends meet, so whatever) - but just how messed up the process is/was. It was just...so wrong and so unfair.
But I think it also can be helpful when I tell people, so they are aware there people out there like this... and can do everything/anything to avoid people/situations like this. Always have proof down to the weather temp. that day - even if there is an non-property damage, non-injury "accident", apparently.

I don't get this part. If you have insurance you cannot be sued personally in my state, the claim would only be against the insurance policy, they cannot go after personal assets. That's what liability insurance essentially is for. The victim couldn't sue you. You can only go after personal assets of the uninsured here.There ar two things that can/could happen here:

The regulation must be different in your state.
All of God's children are not beautiful. Most of God's children are, in fact, barely presentable.
As a condition (CA law?) of taking the settlement offer- he couldn't sue me personally for any additional/future costs or "pain and suffering" relating to this incident.
If he chose to not to take the settlement offer from my insurance, he had the option/right to sue me for however much he thought I owed him - which would have been $40K+
This would just be him going down the the court house and filing a personal lawsuit against me, which anyone could do, at anytime, for anything (depending on the "crime" and the statue of limitations for that "crime" and not insurance claim filing/timing). And insurance wouldn't be involved. He would have the burden of proof that I caused this incident, which he didn't.
But I remember my agent specifically saying the whole suing part , because I started crying, as she was telling me this, at the thought of filing for bankruptcy at 23 years old.
I don't know what the CA specifically says about all this, but I do know that if you're found 100% at fault, even if you didn't do anything wrong or cause it to happen, you're still going to pay![]()
Forget how long it took her to sue Blowhan, I'm a little baffled by the fact she got 6 months to answer the suit.
