Alli Sims served with legal papers sent by Kevin Federline's lawyer

At 2:30 a.m. on Sunday, Britney Spears's longtime pal, Alli Sims, was served with legal papers concerning the ongoing custody battle between Spears and her ex-husband, Kevin Federline, a source tells PEOPLE.

Sims was leaving a party at a private home in the Hollywood Hills when she was served by Aaron Cohen of IMS-Security.

"Alli was really shocked and covered her face," an observer tells PEOPLE. "[She was] really distraught and said 'Oh my God.' "

Spears, who was also at the party, did not witness the serving of the papers, according to the observer.

The papers are a deposition subpoena sent by Federline's lawyer, Mark Vincent Kaplan, compelling Sims to testify about Spears's parenting skills.

Sims, who has known Spears since childhood and is regularly at her side while partying in Los Angeles, recently told PEOPLE: "[Britney] is a wonderful mom and she is so hands-on. ... Britney loves those babies to death. And they adore her."

On Wednesday, Federline filed for primary custody of the couple's two sons, Sean Preston, 22 months, and Jayden James, 10 months.

A source close to Federline told PEOPLE recently that the would-be rapper has been worried about Spears's behavior and thinks she may be exposing the boys to "unnecessary risk."

Alli's the only one who was around her for a long time, I think, since Britney fired all her nannies, managers, and other minders. She'll be the only constant witness to Britney's behavior when she's been alone with the kids. Maybe that's all the credibility she needs for the courts.

i agree. she is caught between a rock and a hard place here. she can hardly say under oath that britney is a good parent but from britney's behavior can she say she really wants her kids? i think she just doesn't want to lose like many people. poor little rugrats. poor crazy britney. she'll be gone soon anyway.

The custody battle is officially on between Kevin Federline and Britney Spears.
According to an Us source, Spears' cousin/assistant, Alli Sims (along with Spear's music producer JR Rotem) was approached early Sunday morning around 2:30 a.m. outside a party at a Hollywood Hills home and served with a deposition subpoena by Aaron Cohen of IMS Security, who, according to another source, is "one the top security guys in Hollywood."
A visibly upset Sims attempted to avoid being served, and she and Rotem began to argue with Cohen. But, as an eyewitness reports, Cohen was not deterred by Sims' denials and was forced to throw the subpoena through an open car window as Sims and Rotem fled in a friend's car. Spears was spotted leaving the the same party moments later and eventually joined Sims and Rotem at her Beverly Hills home.
Federline's attorney, Mark Vincent Kaplan has made it very clear that his client has serious concerns about the safety and welfare of his and Spears' two children, Sean Preston, 23 months, and Jayden James, 11 months.
"Kevin would like to have as much custody as he could because he feels that the children would benefit from that," Kaplan tells Us
According to a source familar with the custody battle, Sims' deposition gives Kaplan the ability to, "ask her about everything. What she feeds the kids, what's going in the bottles, how late they're staying up and about what Britney is like when she parties."
Federline's attorney appears to be wasting no time acting on his client's behalf. On August 8, the attorney filed documents in the family law department of the L.A. Superior Court that, according to another Us source, may have been a petition requesting the court grant Federline primary custody.

So the above article, as well as this statement, are both from People. Interesting. Can't they keep their facts straight?

I have a hard time believing Alli will not lie for Brit. They are related, aren't they? Also, Alli is not going to sabotage the tracks her gravy train is running on. Unless KFed has visual evidence that would prove perjury, Alli probably should not be trusted to tell the whole truth.
