Nick Lachey Files for Spousal Support

ET has learned that NICK LACHEY has filed papers in L.A. Superior Court today requesting spousal support from JESSICA SIMPSON in response to her divorce petition. Property assets and obligations have not been established yet in the proceedings.
Jessica filed for divorce from Nick in mid-December, citing "irreconcilable differences" as the reason for the split. In her papers, Jessica is seeking to terminate the court's ability to award spousal support to Nick, and wants to restore her name back to "Jessica Simpson" from her legal married name of Jessica Simpson Lachey.
The popular "Newlyweds" fought off break-up rumors for nearly a year, then eventually announced their split last November with the following official statement:
"After three years of marriage, and careful thought and consideration, we have decided to part ways," the couple said. "This is the mutual decision of two people with an enormous amount of respect and admiration for each other. We hope that you respect our privacy during this difficult time."
The couple married in Austin, TX, in front of 350 guests in an hour-long Baptist ceremony. Jessica wore a strapless VERA WANG gown and Nick sang "My Everything," a song he wrote just for his bride.

Poor little Jessica will have to do extra Pizza Hut commercials just to make ends meet.

Spousal support just means that Jessica would have to give Nick a certain amount of money for a certain amout of time... like $2,000 a month for 3 years, or a lot more... just depends on what they decide is fair and reasonable. I think he's more likely to get it if she cheated on him, and there's probably a lot of other factors involved. One of our several lawyers on the board can probably shed more light on this, I know very little about how it works.
I say GO NICK! If she cheated on him and then dumped him to go have some big career without him nagging her about money and screw around as much as she wants, I'd say he's earned it.
This is from a page on California laws regarding spousal support:

When the judge makes his or her final order, the judge must consider the factors in California Family Code section 4320.
These factors are:- The length of the marriage or domestic partnership,
- What each person needs,
- What each person pays or can pay (including earnings and earning capacity),
- Whether having a job would make it too hard to take care of the child(ren),
- The age and health of both people,
- Debts and property,
- Whether 1 spouse or domestic partner helped the other get an education, training, career, or professional license,
- Whether there was domestic violence in the marriage or domestic partnership,
- Whether 1 spouse's, or domestic partner's, career was affected by unemployment, or by taking care of the children or home, and
- The tax impact of spousal support (note: federal and state tax laws were not changed to recognize domestic partnerships.)

I think California is a no-fault divorce state, so who caused the marriage to fail should not be a factor in determining how the assets will be divided or who will get support.

It is a no-fault divorce state, but they still do spousal support there. As far as I know, the no-fault part only means that you don't list a "reason" for the divorce, like adultery (which is why I get SO annoyed when these stories mention they cited "irreconcilable differences", because that's the ONLY option to list, other than "insanity"), and they split property right down the middle. There's probably more to it than that, but I know they still do alimony and child support there.

In divorce papers, Nick Lachey is seeking spousal support from Jessica Simpson, and he wants his jewelry back.
In court papers filed Friday in response to Simpson's Dec. 16 divorce filing, Lachey cited irreconcilable differences for the dissolution of the three-year marriage.
Lachey, 32, also asked for "miscellaneous jewelry and other personal effects," part of Simpson's earnings from after the date of separation and other assets.
Lachey said he and Simpson separated Dec. 13, although she claims it was Nov. 23.
The couple, who starred in their own MTV reality show, "Newlyweds: Nick & Jessica," had no prenuptial agreement and in her petition, Simpson asked the court not to grant Lachey spousal support.
Lachey, who gained fame as a member of the boy band 98 Degrees, had more earning power when the couple wed in October 2002. However, Simpson's fame skyrocketed during the marriage. The 25-year-old singer-actress reportedly earned more than $30 million last year, including earnings from her big-screen debut playing Daisy Duke in "The Dukes of Hazzard" movie.
Last month, the Mediterranean-style house the pair shared during "Newlyweds" was sold to "Malcolm in the Middle" teen actor Justin Berfield for an undisclosed price.

I hope this is not true. A man asking for spousal support from their former wife sounds so pathetic. Nick seems like the type of individual who works for his money. He needs to link up with Pharell and Jermaine Dupri and create a kick ass album. Then make his boots walk all over Jessica's flat ass.

I don't see any difference between a man asking for support and a woman asking for support. Equality is a two way street. Actually, I think anyone who's making decent money should not be asking for support at all...and that goes for both sexes. But this sounds more like punishment.
