    10:05 AM PT -- Kim Foxx responded to the order, saying, "I respectfully disagree with the court's conclusion that, in the absence of any conflict, the appointment of a special prosecutor is required."
    She continued, "As always, I remain committed to transparency, justice, and the public safety of the communities we serve."Jussie Smollett could actually be prosecuted for allegedly faking the now infamous attack on the streets of Chicago.
    A Chicago judge has ordered a special prosecutor to be appointed to review the way prosecutors handled the case and ultimately dismissed it.
    The judge said in his order, "If reasonable grounds exist to further prosecute Smollett, in the interest of justice the special prosecutor may take such action."

    This is a stunning turn of events ... as you know, the Office of State's Attorney Kim Foxx essentially dropped all charges against Jussie ... this after the grand jury indicted the actor on 16 felony counts of lying to cops. Jussie claimed he was attacked by 2 men who beat him and put and put a rope around his neck while yelling racial and homophobic slurs. Cops called BS.

    The judge said, "unprecedented irregularities identified in this case" warrants the appointment of a special prosecutor. Some of the irregularities, according to legal docs:
    The judge said the State's Attorney screwed the case up after Foxx recused herself, because of comments she had made about the case, there was no one in her office properly overseeing the case ... so says the judge.
    The judge used a nautical metaphor to describe the screw-ups, saying, "There was no master on the bridge to guide the ship as it floundered through unchartered waters. And it ultimately lost its bearings."

    Oh my God. This ugliness rearing it's head again, pushing all the racist buttons and agendas, and worst of all, lending fuel to racist rhetoric in the 2020 elections. Is it wrong that at this point, I just wanted the whole thing to fade away?

    ^^^ Maybe not, but I feel differently. I feel that Jussie was trying to push all the buttons by arranging this fake attack. I think Kim Foxx should resign.

    I was trying to post a screenshot from my phone and discovered that tinypic is shutting down...but anyway, I just saw that Empire is filming in the exact location of Jussie's faux attack. Lol

    Judge orders Google to fork over Jussie Smollett data in hoax case

    A judge in Chicago ordered a sweeping search warrant of Google, asking the company to hand over one year’s worth data on “Empire” actor Jussie Smollett, a report said on Wednesday.

    The Cook County judge ordered Google to turn over Smollett’s emails, photos, location data and private messages as part of an investigation into the alleged hoax attack, according to the Chicago Tribune.

    The warrants are seeking a trove of documentation from Smollett and his manager’s Google accounts, the paper said.

    Additional documents requested include email drafts, deleted messages, Google Drive files, Google Voice texts, and web browsing history.

    Smollett has been accused of hiring two brothers to stage an attack on himself that included tales of a noose and bigots screaming racist, homophobic slurs.

    Cops in Chicago, where Smollett lives and alleged the attack against him occurred, have said the disgraced actor made up the whole thing.

    Jussie Smollett indicted in Chicago over allegedly staged 2019 attack

    Jussie Smollett on Tuesday was once again indicted for allegedly staging a hate-crime attack against himself — nearly a year after charges in the case were abruptly dropped.

    Cook County special prosecutor Dan Webb revealed the former “Empire” star had been hit with six new counts of disorderly conduct, accusing Smollett of lying to the Chicago Police Department about the January 2019 incident.

    Webb’s investigation revealed that Smollett “planned and participated in a staged crime attack,” and then “made numerous false statements … reporting a heinous hate crime that he, in fact, knew had not occurred,” Webb said in news release.

    The 37-year-old actor, who is black and gay, told cops that he was jumped by two men who shouted racist and homophobic slurs — as well as, “This is MAGA country!” — at him, in an attack that involved bleach and a noose.

    But huge holes quickly appeared in the high-profile case, and police ultimately determined that Smollett had concocted the whole thing, paying two brothers $3,500 to stage the “attack.”

    On March 8, he was hit with a 16-count felony indictment for filing a false police report — only for Cook County State’s Attorney Kim Foxx to abruptly drop all charges later that month.

    Smollett was let off the hook with the slap on the wrist in exchange forfeiting the $10,000 he had coughed up for bail and performing community service — spurring outrage from police officials and then-Mayor Rahm Emanuel.

    Judge Michael Toomin appointed Webb, a former US attorney, in August to re-examine the case and look into why the charges were nixed.

    Toomin had blasted Foxx for not fully recusing herself from the case over texts about the investigation she’d exchanged with members of Smollett’s family.

    In dropping the charges, Foxx’s office had claimed Smollett was being treated the same as other defendants who’d faced similar charges in previous cases.

    But Webb said prosecutors were unable to provide evidence of any similar, prior cases.

    Foxx’s office also couldn’t identify a shred of new evidence that arose between the initial indictment and its dismissal that would have led prosecutors to believe the case against Smollett wasn’t strong, Webb said.

    Webb said reviving the charges was “in the interest of justice.”

    He noted his office has “reached no conclusions” about whether any officials involved in the case had engaged in wrongdoing and that part of the investigation is ongoing.

    Smollett’s arraignment is scheduled for Feb. 24.

    The “Mighty Ducks” actor faces between one to three years in jail, up to a $25,000 fine and community service if convicted on the fresh charges.

    He is already facing a $130,000 lawsuit from the Windy City over the cost of the police and prosecutorial work to investigate his allegedly bogus charges.

    The State’s Attorney’s office declined to comment.

    Smollett’s attorney Tina Glandian said the indictment “raises serious questions about the integrity of the investigation,” pointing to her client’s pending civil case against the city of Chicago and local cops for “malicious prosecution.”

    “One of the two witnesses who testified before the grand jury is the very same detective Mr. Smollett is currently suing for his role in the initial prosecution of him,” Glandian wrote in a statement.

    “The attempt to re-prosecute Mr. Smollett one year later on the eve of the Cook County State’s Attorney election is clearly all about politics not justice.”

    Still think that Kim Foxx should have been canned way back when. And Jussie should get some kind of punishment for faking a HATE and HOMOPHOBIC crime. It's bad enough that he faked the crime at all, but add in all those other aspects ... he deserves more punishment than forfeiting his $10K bond.

    oh my god who fucking cares about jussie smollett? how is this shit not over yet? everyone knows he faked it but if the cops and the city of chicago handled it so badly and couldn't charge him the first time, just let it the fuck go and let everyone get on with their lives. there is no pressing societal imperative to see him locked up nor does his getting away with it represent a huge miscarriage of justice - not like, say, the hundreds of black people killed and beaten by police with impunity. doesn't the police have better things to do with its time?

    ^ Yeah, I'm not sure why they hired a special prosecutor but then again, I'm not sure why Jussie had the balls to file a civil complaint against the city for malicious prosecution. If he's that hellbent on proving his innocence, then he's an idiot who deserves what he gets.
