ITA that even if the passenger had been wearing a seatbelt the the outcome may have been the same. Didn't the car have airbags tho? Weren't they proved to be safer?

I believe it did have airbags. That's why Nick wasn't badly injured as his friend was, because he wasn't wearing a seatbelt and Nick was. And your right. It is the same in US to charge someone for not wearing a seatbelt.
