I don't know if its the same in the US but in the UK, if the passengers in a vehicle (in the front) aren't wearing a seatbelt the driver can be charged with it, as in (UK) law its the driver's responsibility to ensure that the law is complied with.
(Therefore if this had happened in the UK it would have been Hogan Jnr's liability that the passenger wasn't wearing his seatbelt)

ITA that even if the passenger had been wearing a seatbelt the the outcome may have been the same. Didn't the car have airbags tho? Weren't they proved to be safer?
