ITA. It makes zero sense- you are absolutely right.
At any rate, here are two other names I'll throw out there for Court nominations (in my pipe dreams). They haven't served as judges though.
Alan Dershowitz:
'He has been described by Newsweek as America's "most peripatetic civil liberties lawyer and one of its most distinguished defenders of individual rights" and by Corriere della Sera as "America's most famous progressive lawyer."

David Boies:
Famous for working on the cases of Bush vs. Gore (he represented Gore); the Napster case, the Microsoft anti-trust case, and a zillion others. I would *love* to see him on the Court. He's one of the most brilliant legal minds alive today.
